Mojitogames SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES ARE QUALIFIED), ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OF SERVICE OR THE SERVICE ITSELF, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT Mojitogames HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Mojitogames SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID TO Mojitogames IN ACCORDANCE WITH THESE TERMS OF SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. Any claim or dispute between you and Mojitogames that arises in whole or in part from your use of the Service shall be decided exclusively by a court of competent jurisdiction located in Los Angeles County, California, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non convenience with respect to venue and jurisdiction in the state and federal courts of California. If you are a resident of the Japan, you agree that all disputes between you and Mojitogames shall be governed by the laws of Japan, without regard to conflict of law provisions. If any portion of these terms of Service or of the Mojitogames Privacy Policy becomes illegal or unenforceable, such provision shall be replaced as the California law defines. If you are a resident of the Japan, such provision shall be replaced as the Japan law defines. ​ ​ ​ General Provisions ​ Mojitogames may assign or delegate these Terms of Service and/or the Mojitogames Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. ​ 모바일 통합 캐시정책 제1조 목적 제2조 용어의 정의 제3조 정책의 변경 제4조 유료 서비스의 내용 등의 게시 제5조 충전 및 구매 제6조 충전 결제 수단 제7조 이용제한 제8조 캐시의 환불 및 청약 철회 제9조 과오금의 환불 제10조 캐시의 소멸 등 제11조 손해배상 제12조 게임이용자의 책임 제13조 개인정보의 보호 제14조 면책조항 제15조 준거법과 재판권 제16조 정책 외 사항 ​ 제1조 목적 ​ 모히또게임즈 모바일 캐시정책은 (주)모히또게임즈(이하 "회사")에서 운영하는 모바일 게임서비스를 이용하기 위하여 필요한 “캐시”의 충전, 구매, 사용, 환불 등과 관련한 ‘회사와 게임이용자가 준수하여야 할 사항을 규정함’을 목적으로 합니다. ​ ​ 제2조 용어의 정의 ​ 가. 캐시: 모바일 게임서비스 내에서 유료 콘텐츠를 이용하는데 사용할 수 있는 인터넷상의 사이버 머니를 지칭합니다. 나. 충전: 게임이용자가 일정량의 캐시를 확보하기 위하여 회사가 지정하는 특정 결제수단들을 통해 게임이용자가 원하는 결제 수단을 선택하여 결제하는 행위를 말합니다. 특정 결제수단은 [(원스토어(One store)-원스토어(주)/ 앱스토어(Appstore)-애플(Apple Inc.)/ 플레이스토어(Play Store)-구글(Google Inc.) 등]을 지칭합니다. 다. 구매: 충전된 캐시를 지불하여 회사가 제공하는 아이템 구입 등의 게임서비스를 이용하는 행위를 말합니다. 라. 환불: 충전된 내역을 본 약관 21조의 환불기준에 의거 현금 혹은 신용카드 매출취소 등으로 되돌려 받는 것을 말합니다. 마. 미성년자: 모바일 캐시정책(이하 “이 정책”)에서의 미성년자는 오늘 날짜를 기준으로 만 14세 미만을 의미합니다. 바. 게임이용자: 모바일 게임서비스를 제공 받기 위하여 회사와 이용계약을 체결하고 아이디(ID)와 회원번호를 부여 받은 자를 의미합니다. 사. 해지: 게임이용자가 이용계약 해약하거나 또는 게임탈퇴를 말합니다. 아. 이벤트 캐시: 모바일 게임서비스에서 이벤트 및 장애보상, 기타 회사정책으로 무상 지급된 캐시를 말합니다. 단, 이벤트캐시는 회사에서 정한 유효 기간 내에 사용 가능합니다. 자. 유료 콘텐츠: 유료 아이템 등 회사가 제공하는 유료 서비스를 말합니다. ​ ​ 제3조 정책의 변경 ​ 가. 회사는 ‘전자상거래 등에서의 소비자보호에 관한 법률’, ‘정책의 규제에 관한 법률’, ‘게임산업진흥에 관한 법률’, ‘정보통신망이용촉진 및 정보보호 등에 관한 법률’, 디지털 콘텐츠 산업 발전 법’ 등 관련 법령 또는 상관습에 위배되지 않는 범위에서 이 정책을 개정할 수 있습니다. 나. 회사가 본 정책을 개정하는 경우에는 적용일자 및 개정사유를 명시하여 현행 정책과 함께 서비스 초기화면에 그 적용일자 7일 이전부터(중대한 사항의 변경은 30일 이전부터) 적용일 후 상당기간 동안 공지하거나 전자우편, 휴대폰 문자서비스, 게임 내 메시지 중 하나를 선택하여 고지할 수 있습니다. 다. 게임이용자는 개정된 정책에 대하여 동의하지 않을 권리가 있습니다. 게임이용자가 개정된 정책을 고지 후 변경 적용 일까지 동의 또는 거부의 의사표시를 하지 않은 경우에 회사는 변경 정책 적용에 동의한 것으로 간주합니다. 라. 게임이용자가 개정된 정책의 적용에 동의하지 않는 경우 회사 또는 게임이용자는 모바일 게임서비스 이용계약을 해지하거나, 회사가 구 정책에 따른 서비스 제공이 기술적, 영업적으로 가능한 경우에는 구 정책대로 서비스를 제공할 수 있습니다. ​ ​ 제4조 유료 서비스의 내용 등의 게시 ​ 가. 회사는 다음 사항을 해당 유료서비스의 이용 초기화면 등에 게임이용자가 알기 쉽게 표시합니다. 1. 유료서비스의 명칭, 종류 및 내용 2. 유료서비스의 가격 3. 유료서비스의 제공기간 나. 회사에서 제공하는 유료서비스의 이용권은 게임이용자가 구매하는 즉시 게임이용자의 캐릭터로 지급되며, 유료서비스 이용기간 동안 사용할 수 있습니다. 다. 회사가 제공하는 유료 서비스의 정보 및 이용 조건, 서비스의 이용등급 등에 대한 사항은 아래와 같습니다. 1. 공급자: 모히또게임즈(주) 2. 이용조건: 게임 내 구매 페이지에 별도 표시된 이용조건을 따름 3. 이용등급: 홈페이지 또는 게임 내 별도 표시된 이용등급정보에 따름 4. 이용기간: 게임 내 구매 페이지에 별도 표시된 이용기간을 따름 5. 결제금액: 게임 내 구매 페이지에 별도 표시된 결제금액을 따름 6. 상품제공방식: 캐시 정책 4조 규정에 의함 7. 청약철회 또는 계약해제·해지, 과오금지급: 캐시정책 규정에 의함 8. 피해보상/불만처리에 대한 사항: 운영정책 규정에 의함 9. 상담방법: 홈페이지 고객센터 ​ ​ 제5조 충전 및 구매 ​ 가. 캐시의 충전은 회사의 게임이용자에 한하여 가능합니다. 나. 캐시는 특정 결제수단을 통해 구매할 수 있습니다. 또한, 충전금액, 결제 방식, 결제 절차 등은 각 특정 결제수단 별 정책이 적용됩니다. 다. 캐시의 충전은 결제 정보제공에 대한 동의를 하여야 이용이 가능하며 동의한 게임이용자의 결제정보는 결제 서비스의 제공 및 정산을 위해 결제대행사에 정보가 제공됩니다. 라. 게임이용자는 서비스를 사용하고 있는 단말기의 종류에 따른 각 앱스토어 사업자의 결제 운영정책에 따라 유료 콘텐츠를 구매할 수 있으며, 해당 결제 정책의 차이로 인해 결제금액의 차이가 발생할 수 있습니다. 또한 유료 콘텐츠의 구매 대금은 앱스토어 사업자와 연계된 이동통신사나 플랫폼사업자 및 앱스토어사 업자가 정하는 방법 및 정책에 따라 부과되며, 납부방식 역시 해당 사업자의 정책을 따릅니다. 마. 미성년자의 In-App결제가 법정대리인으로부터 처분을 허락 받은 재산의 범위 내인 경우 또는 미성년자가 사술 등을 사용하여 성년자로 믿게 한 때에는 취소가 제한됩니다. In-App아이템 구매자가 미성년자인지 여부는 In-App결제가 진행된 단말기 또는 신용카드 등 결제수단의 명의자를 기준으로 판단됩니다. ​ ​ 제6조 충전 결제 수단 ​ 가. 콘텐츠에 대한 구매 대금은 원칙적으로 이동통신사와 앱스토어 등에서 정하는 정책, 방법 등에 따라 부과되며 납부 방법 역시 정해진 방법에 따라 납부해야 합니다. 회사 및 결제업체(이동통신사, 앱스토어 사업자 등)의 정책, 정부의 방침 등에 따라 각 결제수단별로 한도가 부여 또는 조정될 수 있습니다. 나. 개별 결제수단별로 이용요금을 정상적으로 납부하지 않은 경우 회사는 해당 게임이용자의 서비스이용을 제한할 수 있습니다. 다. 이용자가 단말기 및 오픈 마켓의 비밀번호 설정 기능 등을 이용하지 않거나 부주의하게 노출하여 발생하는 제3자의 결제에 대하여는 회사가 어떠한 책임도 부담하지 않습니다. ​ ​ 제 7조 이용제한 ​ 가. 게임이용자가 본 정책을 위반하는 경우 회사의 ‘운영정책’에 의하여 회사는 사전 통지 없이 이용 계약을 해지하거나 또는 기간을 정하여 서비스 이용을 제한할 수 있습니다. ​ ​ 제 8조 캐시의 환불 및 청약 철회 ​ 가. 캐시 충전서비스 관련하여 다음과 같은 경우에 해당된다면, 고객센터를 통한 환불 신청 절차에 따라 환불을 받을 수 있습니다. 1. 캐시를 충전했으나, 캐시를 사용할 수 있는 서비스가 전무하여 그에 대한 책임이 전적으로 회사에 있는 경우. (단, 사전에 공지된 서비스 점검의 경우 등 제외) 2. 사용하지 않은 캐시가 남아 있는 상태에서 불가피한 사유로 서비스를 해지하거나 사용하지 못하게 되는 경우. 3. 기타 소비자 보호를 위해 회사에서 따로 정하는 경우. 나. 회사는 환불 신청한 게임이용자에 대하여 사용하지 않은 잔여 캐시를 기준으로 10% 수수료를 제외한 금액에 대해 현금 환불을 진행합니다. (단, 환불금액이 1,000원 이하인 경우에는 환불하지 않습니다. 또한, 결제승인취소가 가능할 경우에는 결제승인취소로 환불을 대신하여 해당 결제수단으로 결제금액을 재 환원할 수 있습니다.) 다. 다음에서 정하는 ‘캐시’의 경우에는 환불이 불가능합니다. 1. 문화상품권(원스토어) 등으로 충전한 ‘캐시’ 2. 이벤트 참여를 통하거나 회사로부터 무상으로 지급 받은 ‘이벤트캐시’ 3. 기타 게임이용자가 직접 충전하지 않은 ‘캐시’ 라. ‘게임이용자’은 ‘회사’에 환불을 요청할 시에 본인 신분증 사본, 통장 사본 (납입), 납입 증명서 등을 제출하여야 하며 ‘회사’는 필요 서류를 받은 후 ‘게임이용자’이 ‘충전’ 금액을 정상적으로 입금하였음이 확인된 날로부터 3영업일 이내에 이용대금의 결제와 동일한 방법으로 환불절차를 진행합니다. 다만 결제방식에 따라 입금확인에 소요되는 시간이 3영업일 보다 장기인 경우에는 환불처리가 다소 지연될 수 있습니다. 마. 애플리케이션을 통한 결제는 앱스토어 사업자가 제공하는 결제방식에 따릅니다. 따라서 결제 과정에서 과 오금이 발생하는 경우 원칙적으로 앱스토어 사업자에게 환급을 요청하여야 합니다. 단, 앱스토어 사업자의 정책, 시스템에 따라 가능한 경우 회사가 앱스토어 사업자에게 필요한 환급절차의 이행을 요청할 수도 있습니다. 바. 게임이용자가 구매하는 유료 콘텐츠는 청약철회가 가능한 콘텐츠와 청약철회가 제한되는 콘텐츠로 구분되며, 이는 게임이용자가 유료 콘텐츠를 구매하는 경우에 표시됩니다. 청약철회가 가능한 콘텐츠에 대해서는 구매일로부터 7일 이내에 청약철회를 하여야 합니다. 사. 다음과 같은 경우 유료 콘텐츠의 청약철회가 제한되며 회사는 청약철회가 제한되는 유료 콘텐츠에 대해서 결제 전에 청약철회가 제한됨을 표시합니다. 1. 구매 후 즉시 사용이 시작되거나 즉시 애플리케이션에 적용되는 아이템의 경우 2. 애플리케이션의 정상적인 이용과정에서 결제 없이 획득한 아이템의 경우 3. 추가적인 혜택이 제공되는 아이템에서 해당 추가 혜택이 사용된 경우 4. 묶음형으로 판매된 아이템의 일부가 사용된 경우 5. 개봉행위를 사용으로 볼 수 있거나 개봉 시 효용이 결정되는 캡슐형/확률형 아이템의 경우 아. 회사는 게임이용자가 청약철회의 의사표시를 한 날로부터 또는 게임이용자로부터 계약해지의 의사표시를 받은 날로부터 3영업일 이내에 대금의 결제와 동일한 방법으로 이를 환급하며, 동일한 방법으로 환불이 불가능할 때에는 이를 사전에 고지합니다. 단, 수납확인이 필요한 결제수단의 경우에는 수납확인일로부터 3영업일 이내에 이를 환급합니다. 자. 게임이용자는 제 바항 내지 제 사항의 규정에도 불구하고 유료서비스의 내용이 표시 및 광고 내용과 다르거나 계약 내용과 다르게 이행된 경우에는 구매 당일 또는 유료서비스 이용 가능일로부터 3월 이내, 그 사실을 안 날 또는 알 수 있었던 날부터 30일 이내에 청약철회를 할 수 있습니다. ​ ​ 제 9조 과오금의 환불 ​ 가. 게임 이용자가 대금을 결제함에 있어서 과오금이 발생한 경우 회사는 대금 결제와 동일한 방법으로 과오금을 환급하여야 합니다. 다만, 동일한 방법으로 환급이 불가능할 떄는 이를 사전에 고지합니다. 나. 회사의 책임있는 사유로 과오금이 발생한 경우 회사는 과오금 전액을 환불합니다. 다만, 게임이용자의 책임있는 사유로 과오금이 발생한 경우는 제6조에 정한 방법으로 환불합니다. 다. 회사는 게임 이용자가 주장하는 과오금에 대해 환불을 거부할 경우 정당하게 이용대금이 부과되었음을 입증하여야 합니다. ​ ​ 제 10조 캐시의 소멸 등 ​ 가. 캐시는 마지막 이용일로부터 1년(365일) 경과 시까지, 거래내역이 없을 경우 상사소멸시효에 따라 소멸될 수 있습니다. 단, 무상으로 제공하는 이벤트캐시의 경우는 전단과 별도로 회사의 정책에 따라 소멸될 수 있습니다. ​ ​ 제 11조 손해배상 ​ 가. 회사는 서비스의 중대한 결함에 의하여 디지털 콘텐츠가 손상, 훼손, 삭제되어 서비스 이용에 손해를 입은 게임이용자에게 해당 디지털 콘텐츠의 복원 또는 캐시 재충전으로 보상합니다. 다만, 회사는 회사의 고의 또는 과실 없이 게임이용자에게 발생한 일체의 손해에 대하여 책임을 지지 않습니다. 나. 게임이용자가 이용정책의 '이용제한 관련 각 호의 규정'에 근거하여 이용제한 또는 이용 해지된 경우, 게임이용자가 보유한 모든 디지털 콘텐츠의 사용권은 상실되며 회사는 해당 디지털 콘텐츠의 구매대금을 반환할 책임을 부담하지 않습니다. 다. 회사는 서비스의 변경 또는 중지로 인해 특정 디지털 콘텐츠가 소멸될 경우에는 7일 이상 사이트에 공지를 하고 사용권이 남은 디지털 콘텐츠를 유료로 구매한 게임이용자에 한하여 등가의 신규 디지털 콘텐츠 또는 캐시 등으로 보상하며, 사용기간은 해당 디지털 콘텐츠의 잔여기간으로 합니다. 라. 회사는 자체 서비스의 중대한 하자에 의거하여 유료 콘텐츠가 손상 또는 훼손되거나 삭제된 경우 회사는 회사의 선택으로 등가의 유료서비스, 포인트 캐시등으로 보상합니다. ​ ​ 제 12조 게임이용자의 책임 ​ 가. 게임이용자는 본 정책과 관련법령에 의하여 정해진 경우를 제외하고 게임이용자 본인의 결제정보에 대한 관리책임이 있으며, 게임이용자 본인의 결제정보를 제3자가 임의로 이용하게 해서는 안되며 이에 대한 책임은 게임이용자가 부담합니다. ​ ​ 제 13조 개인정보의 보호 ​ 가. 회사는 인증수단 정보 등을 포함한 이용자의 개인정보를 게임이용자의 사전 동의 없이 제3자에게 누설, 배포할 수 없습니다. 단, 관련법령 및 요금정산에 필요한 경우에는 그러하지 않습니다. 나. 기타 이용자 개인정보의 보호 및 사용에 대해서는 관련법령 및 회사가 별도로 고지하는 “개인정보처리방침”이 적용됩니다. 제 14조 면책조항 ​ 가. 회사는 천재지변, 전쟁, 폭동, 정부의 규제, 파업, 정전, IDC 장애, 서비스용 설비의 보수 등 회사가 통제할 수 없는 불가항력으로 인하여 서비스를 제공할 수 없는 경우에는 서비스 제공에 대한 책임이 면제됩니다. 나. 서비스 점검이 불가피한 경우 및 사전에 공지한 경우에는 책임이 면제되며 불가피한 사정으로 인해 사전 공지된 작업의 일정은 지연될 수 있습니다. 다. 회사는 캐시의 이용과 관련하여 회사의 고의 또는 과실 없이 이용자에게 발생한 일체의 손해에 관하여 책임을 부담하지 않습니다. 라. 회사는 게임이용자 또는 제3자의 귀책 사유로 인한 서비스 이용 중단 및 장애에 대해서는 그 책임을 지지 않습니다. 마. 회사는 게임이용자가 서비스를 이용하여 기대하는 수익을 상실한 것에 대하여 책임을 지지 않으며, 서비스를 통하여 얻은 자료로 인한 손해에 관하여 책임을 지지 않습니다. 바. 회사는 게임이용자의 단말기 환경으로 인하여 발생하는 제반 문제 또는 회사의 귀책사유가 없는 네트워크 환경으로 인하여 발생하는 분제에 대하여 책임을 지지 않습니다. 사. 회사는 관련 법령, 정부 정책 등에 따라 서비스 또는 게임이용자에 따라 서비스 이용시간을 제한할 수 있으며, 이러한 제한 사항 및 제한에 따라 발생하는 게임 이용관련 제반 사항에 대해서는 책임을 부담하지 않습니다. ​ 제 15조 준거법과 재판권 ​ 가. 회사와 게임이용자간에 발생한 전자거래 분쟁이 있는 경우 양 당사자간의 협의로 원만히 해결함을 원칙으로 하되 만약 그 분쟁이 원만히 해결되지 않아 소송을 제기할 경우, 소의 관할은 제소 당시의 이용자의 주소에 의하고, 주소가 없는 경우에는 관련 법령에 따른 법원을 관할 법원으로 합니다. ​ ​ 제16조 정책 외 사항 ​ 가. 본 정책에 명시되지 아니한 사항에 대해서는 회사 이용 약관 및 기타 회사가 정하는 정책에 따릅니다. 나. 이용자의 개인정보 보호에 관한 사항은 개인정보처리방침에 따릅니다. 다. 기타 회사가 정하는 정책 또는 이용 약관에 명시되지 아니한 사항에 대해서는 전기통신사업법 등 관계법령과 상관습에 따릅니다. ​ 부칙(시행일) 본 정책은 2020년 1월 14일부터 시행됩니다. ​
